Caregiver Agreement

This Caregiver Agreement supplements the Compass Care 365 Terms of Service and applies to every Caregiver listed on the platform. By creating a Caregiver profile, you agree to these professional standards.
1. Independent Operator Status
You are an independent business owner. Compass Care 365 is not your employer. You set your own rates, hours, services offered, and clients you accept. You are responsible for your own taxes, insurance, and business compliance.
2. Truthful Credentials
- All documents you upload (background checks, CPR certificates, insurance, identity) must be genuine, current, and your own.
- You will keep your credentials current and re-upload renewed documents promptly. Expired credentials may result in your verification badges being removed.
- Misrepresenting credentials is grounds for permanent removal from the platform and may be reported to relevant authorities.
3. State Compliance
You will comply with all applicable state and local requirements for non-clinical care, including business registration, any required caregiver registries, and any state-specific bonding or insurance requirements. Your state-specific roadmap inside Compass Care 365 is a guide, not legal advice.
4. Scope of Practice
You will only provide non-clinical, non-medical services unless you hold the appropriate professional license. You will not administer medications, perform medical procedures, or hold yourself out as a licensed medical professional.
5. Family Communication
- You will respond to family inquiries in a timely, respectful, professional manner.
- You will be honest about your availability, services, and rates before accepting any engagement.
- You will not solicit families for services off-platform to circumvent platform fees.
6. Safety & Conduct
- You will maintain a safe environment for clients at all times.
- You will report any suspected abuse, neglect, or self-harm in accordance with state mandatory-reporter laws.
- You will not engage in any form of harassment, discrimination, theft, or financial exploitation of clients.
7. Subscription & Marketplace Access
Your active subscription ($49/month after the $149 activation) keeps your profile listed in the directory and your dashboard tools active. If your subscription lapses, your public profile will be hidden until reactivated.
7a. Payment Intermediary — You Are the Merchant of Record for Service Payments
When a Family pays you for caregiving services through Compass Care 365's payment infrastructure, the payment is processed via Stripe Connect Direct Charges. That means:
- You are the Merchant of Record for the service payment. The funds are charged to your own Stripe Express account (which you create and own) and are paid out to your bank account directly. Compass Care 365 is the payment intermediary and technology platform — not a party to the service contract between you and the Family.
- Compass Care 365 collects a flat 10% application fee on each service payment. Stripe processing fees (~2.9% + $0.30) are deducted from your portion at standard Stripe rates. You keep the remainder.
- You are solely responsible for refunds and chargebacks on service payments. If a Family disputes a charge, the disputed amount, any chargeback fees, and any associated investigation are handled out of your Stripe balance. Compass Care 365 will not cover, refund, or absorb these costs.
- You are solely responsible for sales tax on service payments in every state and locality in which you provide services. Compass Care 365 does not calculate, collect, remit, or file sales tax on service payments. Consult a tax professional about your obligations.
- To accept service payments, you must complete Stripe Connect Express onboarding (KYC: legal name, date of birth, address, taxpayer ID, and bank account). Until onboarding is complete and Stripe has enabled charges on your account, the "Accept Family Payment" feature will be disabled on your profile.
- You agree to keep your Stripe Connect account in good standing and to comply with Stripe's Connected Account Agreement (which you accept directly with Stripe during onboarding).
8. Termination
Compass Care 365 may suspend or remove your account for violation of this Agreement, the Terms of Service, or for any conduct that endangers clients or harms the platform's trust with families.
9. Indemnification
You agree to indemnify and hold harmless Compass Care 365 from any claims arising out of the care services you provide, your business operations, or your breach of this Agreement.
10. Acknowledgment
By maintaining a Caregiver profile, you acknowledge you have read, understood, and agree to be bound by this Agreement.
